Spousal Debt Mental Illness

2010-03-28

The most important point to make is that you are not liable for your spouses debt, ever, unless you have guaranteed or co-signed the debt. Accordingly your husband's creditors cannot pursue you for the debt, only him, and can only garnishee his wages (of which he has none) or seize his non-exempt assets. Please feel free to contact me and I will advise which assets are, and are not, exempt. If you have power of attorney, or have been appointed by the court, you can also, if necssary, have him placed in bankruptcy, file a proposal etc. Ian Schofield MNP Regina 306-790-79004
