Can I Sue Someone For Personal Injury If Ive Been In Bankruptcy

2009-10-12

If the injury occurred after the date of your bankruptcy, and particularly if it was after your discharge from bankruptcy, the bankruptcy wouldn't prevent you from suing the party who caused the injury. If, however, the injury occurred prior to the start of your bankruptcy, your creditors may have a right to some of the recoveries from a personal injury claim.  You should talk to your trustee and your lawyer about this before proceeding.
