In situations where a company refuses to voluntarily make an assignment in bankruptcy, one or more creditors may apply for a court-ordered bankruptcy. In adversarial situations between creditors and a company, an application to Court for a bankruptcy order and the appointment of a Licensed Insolvency Trustee may be necessary. Upon written consent, MNP can be named as the Trustee in the bankruptcy application and immediately administer the estate under the Bankruptcy and Insolvency Act (BIA) once the bankruptcy order is issued.
